 Car insurance rip off
Hi,

I was involved in a car accident about a month ago. I feel that the other guy had all the fault, but his insurance company is only willing to pay 90% for the damage of my car. They are claiming that 10% of the accident had been my fault. The reason that I feel that the other guy's insurance should pay 100% for my damages is because the guy was making a left turn, and I was going straight. I definitely had the "right of way," so I have been told. They also claim that I'm 10% at fault since the other guy almost cleared his left turn.

I was advised by someone to call back the insurance company and to tell them that I didn't agree with their terms on their estimate, since I'm not at fault for nothing. A left turn was a left turn, no matter which part of his car I collided with. And there's another thing. They are only willing to pay for parts from Taiwan, which are not original.

I need some legal advise, and possibly a lawyer to help me fight for the 100% and for original parts. Maybe even to sue them for putting me through this, since it's causing me so much emotional stress.

Which state are you from and did the accident occur in that state? Hope you are not from a jurisdiction that follows contributory negligence where the court bars any recovery at all if the plaintiff is at fault even to the slightest degree.

Sounds like the driver making a left turn was negligent and if you had no chance to avoid the collision, you wouldn't be 10% at fault. If you had a chance to stop and avoid the accident but you didn't, you may be comparatively or contributory negligent. The insurance company saying they will only get Taiwan parts are absurd. That may further reduce the value of the 90% of their compensation assuming 90% is even valid in the first place.

If you also have been injured from the accident or suffered an emotional distress, you can claim these when you sue. Those claims will leverage out your negotiation with the insurance company. Talk to a personal injury attorney in your area.

Sounds like that guy is 100% at fault. Even if you stopped properly as soon as you see him making an illegal left turn, you probably would have still hit him.

I can see why they set 10%....you can try to fight it but their decision will unlikely change...Try contact your state's department of insurance.
