 Criminal liabilities from car accidents
In most cases, car accidents only end up in civil courts where plaintiffs seek compensation from a defendant. But in some cases, car accidents can lead criminal charges for the driver who caused the accident and injury.

Involuntary manslaughter (also known as vehicular manslaughter in some states):
Involuntary manslaughter is a killing of a human being with criminal negligence or killing while committing a misdemeanor. Criminal negligence here is different from state to state but generally it requires a great degree of negligence that is a higher standard than civil negligence. For example, you could be convicted of involuntary manslaughter if you hit and killed someone if you were driving recklessly or after committing a traffic violation such as speeding or running through a stop sign.

Second degree murder:
Second degree murder is a killing of a human being with an extreme recklessness or depraved indifference to human life. If you killed someone while driving under the influence of alcohol or drug, you would be charged and tried for a second degree murder as well as involuntary manslaughter.

Driving under the influence (DUI):
Most jurisdictions have per se 0.08 blood alcohol level but each state has different penalties involving a DUI. Whether a DUI is a felony or a misdemeanor depends on one's blood alcohol level, previous DUI convictions and other factors surrounding the incident.

Criminal law is the principal means by which the government identifies and criminalises behaviour that is considered wrong, damaging to individuals or to society as a whole or is otherwise unacceptable. The criminal justice system is the mechanism by which action is taken to deal with those suspected of committing offences. The criminal justice system refers to the whole process from the initial investigation of a crime through to acquittal or to conviction and sentence in the criminal courts.

if in doubt, i suggest you call your own insurance company and pose the question that the other at fault company is doing this and this. ask them if you think all is reasonable. if they say yes, do it on your own.

Would criminal liabilities from a car accident result in bigger settlements and compensation? I know in some incidents, the liable driver is booked for wreckless driving. I know when I was a young driver and accidentally rear-ended a car that stopped suddenly in front of me that I was booked for driving too close.
