Got into an accident and Avis Ins. won't pay - HELP
Hi Everyone,
I need every single suggestion and advice I can get with this issue.
I got into an accident with an Avis rental car October 5th last year in the state of Maryland- it was like 5 am in the morning. I rented the car from New Jersey and was in Maryland for the weekend. I hit another car behind, the damage to the other car wasn't that much but the damage on the Avis rental car so so bad that even the two front air bags were activated. I exchanged information with the person I hit and we didn't get the cops involved. When I rented the car, I got a partial loss and damage waiver in the amount of $3,000.
I drove the car to the nearest Avis office, came back later during business hours and filled a report, they gave me another rental car to take me back to NJ. However, I got a call from Avis that since I didn't file a police report at the time of the accident that the partial loss and damage waiver I paid for was not valid - they the contract was breached. To make things worst, they said that the cost of fixing the car is around $12,000 and that I have to pay for that.
Now, I don't know what to do. I don't have $12,000 to pay them and they were very serious regarding the amount and if not paid in full or payment arrangement setup, they will litigate.
So now I don't know what to do. I don't have the money and I'm deeply worried and don't understand why it cost so much to fix the car. I'm very aware that the car was badly damaged. In fact, when I got back to NJ after the accident, I had a mechanic friend that works at Sears Auto check out the car (since they share the same parking lot with Avis) and he told me that it will cost no more than $4,000 to fix.
Please I would appreciate any suggestions or advice that will give me a direction on how to deal with Avis on this issue for I believe that they are riping me off here.

Did you review the contract and it says you must have a police report or you won't be reimbursed? Sounds like they should have warned about that provision if really does say that.

You can always try to file for a police report at a later date and talk to the driver of the other car since you said you exchanged the information on the scene and ask him to cooperate on it. Avis just wants evidence that there actually was an accident in order for their insurance to cover the loss. By supplying the evidence, you should be able to get off the hook. See if a writing from the driver admitting that there was an accident on that day would suffice their insurance's requirement. It sounds like if you were the faulty party in the accident, it should be easier for the driver to cooperate especially since you're not asking him/her that you were not the negligent party.

I would hire an attorney to see what you can do. I have a feeling that in the fine writing it states that you must have a police report. If it doesn't then your lawyer should be able to fix the matter quickly. Otherwise, you may end up having to compensate them for some of the amount.

Hiring a lawyer will surely help you especially to this difficult situation. Avis was taking advantage of the limited knowledge you have. So, you better hire a lawyer to settle this thing without paying too much.
