Insufficient automobile coverage
My friend lives in NY and during Thanksgiving weekend, while her car was parked, someone did cause an accident which not only totaled her car but also five others. Her car insurance had lapsed and because so many cars were involved in the collision the insurance of the driver at fault was not able to cover all of the claims. ford motor company is holding her liable and has had her bank accounts frozen. I have suggested to her that she should immediatly seek legal council, but appriciate any advice I can pass along to her.......

She should sue the driver. She's not at fault. Or tell Ford to sue the driver.

By cross claiming the driver or joining the driver as a party in a suit, you will be able to let Ford go against the driver and whatever the deficiency will be personally against the negligent party (the driver) and not you.

Wonder what Ford motor company has to do with the accident? Maybe the company is the PMSI (purchase money security interest) lender for her car and maybe she is not current on her payments since accident or has defaulted on it. That's the only situation I see from what you told us. Or else how does Ford have a claim against her arising from this accident?

Have her sue the driver of the accident ASAP!! Her insurance company has a limit to what they can pay. The first person to sue will get whatever portion the judge authorizes. If you need further clarification just PM me.

Sounds like a bad situation
Probably Ford Motor provided the auto loan. Now that she doesn't have a car, she's not paying on the loan? Was her insurance lapsed BEFORE or AFTER the accident? That obviously makes a big difference. Have you looked at MichaelSilvers.com for advice in how to move forward in her situation? I am sure they are familiar with situations like this. Just a suggestion.
