What if your insurance policy limit is lower than a claim?
My friend just got into a big accident. She took a left turn at an intersection without looking and a car from the other land going straight hit her car. The car was totaled and the other driver's car was heavily damaged and the driver was hurt badly. He was taken to an emergency and the medical bill came out to be pretty high. My poor friend only had the minimum legal insurance policy limit. What are her options? Thank you in advance for any input.

Your friend can get sued for the balance but if he doesn't own home or other valuable properties, there's nothing to lose.

Oh and filing for bankruptcy is always an option too if things get nasty.

On the other side of the matter, it would be disappointing to hire a personal injury attorney and seek compensation but be unable to get anything because the other party filed for bankruptcy. Is there anything one can do if the other party files for bankruptcy during a settlement? I do understand that bankruptcy is a way to protect someone but is there ways to get compensated down the road?

There are use of depend on policy rules or scheme. A generally joint policy, single policy and other matter. There are use of insurance claim to pay proper time a policy.

Try looking for a good lawyer in your state, so, they can help you with this difficult situation. They know what to do and just be sure that you choose a reputable lawyer.
